Any order of an article on the funtomata.com website implies the buyer’s adherence to the following general terms and conditions of sale.

The buyer cannot confirm an order on the funtomata.com website without declaring that they are aware of the present general terms and conditions of sale when placing the order. The “validation” of the box claiming knowledge of the general sales conditions is equivalent to an electronic signature. It thus acts as a binding contract between the buyer and the seller in the same way as a handwritten signature.

The order will be confirmed by e-mail to the address communicated by the buyer on the order form.

The information entered by the buyer when ordering on the funtomata.com website is binding in the event of an error in the recipient’s delivery address. Funtomata cannot be, in such a case, held responsible for the impossibility of delivering the ordered items.

The prices are indicated in Euros €, all taxes included (VAT of the country of the invoice address of the purchaser), and are valid only at the date of the sending of the order form by the purchaser. The prices indicated are exclusive of delivery costs provided before the order’s validation. When a validated order contains one or more erroneous elements (price, description, photo, coupon, etc.), Funtomata reserves the right to cancel it and proceed with a refund.

For shipments outside of Belgium, the payment of customs duties, local taxes, import duties, or state taxes that may be due shall be the sole responsibility of the buyer who imports the items ordered. Should a product not be available at the time of the order due to our suppliers, the customer will be notified as soon as possible with the option of canceling the order and obtaining a refund of the amount paid for the unavailable product or a replacement with an equivalent product. The order will be shipped as soon as all items are available. Funtomata reserves the right to modify the range of products, their prices, and their availability times depending on the constraints imposed by manufacturers or suppliers. Funtomata shall be obligated to inform the consumer of such changes.

As specified by Belgian law, the customer has a right of cancellation for 14 calendar days starting from the delivery of their order. 

Physical product

The return of physical products is at the expense and responsibility of the buyer. The item must be neither used nor damaged and in its original packaging. The parcel must be made in best practices to protect the article. The transport is under the responsibility of the buyer. A tracking system is recommended. A copy of the invoice must accompany the item to identify the transaction.

Items will be tested upon return. The return will be validated if the item received does not differ from its original condition.

Downloadable product

The order of downloadable products is considered to be delivered as soon as the download link is made available. The product is deemed to be consumed as soon as the download link is clicked, after which it will no longer be possible to cancel the order. The request for a refund must be made using the Cancellation Form.

Refunds

Refunds will be made using the same method of payment you used to place your order. If you paid by Bancontact or bank transfer, please provide us with your full bank details so we can proceed with the refund.

Non-digital items are delivered by a shipping agent to the delivery address indicated by the buyer when placing the order. Funtomata undertakes to make every effort to deliver the order as quickly as possible upon receipt of payment of the order form. The delivery times indicated on the site or the order form are given as an indication only. Any delays do not provide the buyer the right to cancel the sale, refuse the merchandise, or claim compensation. Any claim for non-conformity or shortage must be made within seven days of the date the buyer receives the order.

Funtomata shall be released from its delivery obligation in the event of fortuitous events or force majeure. For example, total or partial strikes, floods, and fires are cases of force majeure. Funtomata reserves the right to split deliveries. Shipping costs will only be charged once.

The purchase of digital products will result in the activation of a download link that can be consulted at any time on the buyer’s account on the Funtomata website. This link will also be sent by e-mail to the buyer’s account address.

All orders placed imply the buyer’s acceptance, without any restriction, of the General Terms and Conditions of Sale of Funtomata. Any dispute relating to the sale shall be subject to Belgian law before the Commercial Court of Liège, Belgium.
